Fraudulent means intent to deceive for money or property.
A sale is fraudulent when the seller hides a material fact or states a false one, and the buyer loses money or property because of it. In the watch market the word covers three acts: passing a copy as a genuine watch, taking payment and shipping nothing, and selling goods that carry a brand mark without permission.
1. A copy sold as genuine
A replica watch is a copy. It is not made by Rolex, Cartier or Omega. A seller who calls a copy "genuine," lists a brand name on the listing, or ships forged papers commits fraud. The buyer pays a genuine price for a copy. That gap between price and product is the loss.
Why Replica Watches Are Unreliable: A Guide to Spotting Failure Points
Disclosure changes the facts. A copy sold with clear notice that it is a copy is a different transaction from a copy sold as the original. The label on the listing is the line.

2. Payment and shipping scams
Common forms: wire transfer or crypto payment with no refund path, a site with no street address and no phone number, stock photos lifted from another store, and a price far below the market for the same model. The seller takes payment, then ships nothing or ships a different item.

3. Counterfeit trademarks
Title 18, Section 2320 of the U.S. Code makes trafficking in counterfeit goods a federal crime. A first offense carries up to 10 years in prison. U.S. Customs and Border Protection seizes counterfeit shipments at ports of entry. A replica that carries a copied brand name and logo is a counterfeit good under that statute.
Checks before paying
- Read the product page. Does it say replica, copy or homage anywhere?
- Check the return address and the refund terms in writing.
- Pay by a method with a dispute process. Card payments carry chargeback rights. Wire transfers do not.
- Compare the price to the market for the same model. A 90% discount on a steel sports watch is a signal, not a deal.
- Look for a business address and a phone number that answer.
What a buyer should keep
Save the listing text, the payment receipt and the shipping label. If the item does not match the listing, the listing text is the evidence. Report card fraud to the card issuer within the dispute window. Report counterfeit goods to the FBI's Internet Crime Complaint Center or to CBP.
One number to hold onto: a genuine luxury watch holds resale value. A copy does not. Any seller who promises resale value on a copy is making a false claim.
